We all know that as per 6CPC recommendations for pension benefits which was also implemented by the Government, CG employees who have completed the qualifying service of 20 years will be eligible for full pension (viz., 50 % of last pay drawn). However, the Government gave effect to this order only from 2.9.2008 and those who retired before 2.9.2008, completion of 33 years of service is mandatory for getting full pension.

As per Office memorandum No: 38/37/08-P&PW(A) dated 2.9.2008 Government Servants who retired during 1.1.2006 to 1.9.08 after completion of 33 years of qualifying service will be eligible for full pension and the pension of those Government Servants who retired before 2.9.08 with qualifying service of less than 33 years will continue to be proportionate to the full pension based on their actual qualifying service.

However, this decision was objected by many of the pensioners as pay benefits except allowance were given with effect from 1.1.06 by the government. Their concern is denying full pension to those who retired between 1.1.06 to 1.9.08 even if they have completed more than 20 years is not rational. Also, according to the affected pensioners, this decision would create phenomenal disparity in the pension benefits between the one who retired from Jan-06 to Aug-08 and others who retired after Sept-08.

Many representations were forwarded to Government by the pensioners to rectify this disparity and to take a uniform stand for providing full pension to all those who retired after 1.1.06, if they have completed 20 years of service.

However, by issue of the Office memorandum dated 12.05.09, Government ruled out full pension for those who retired after 1.1.2006 but before 2.9.2008, even if they had completed 20 years of service. As per this latest clarification (OM dated 12.05.09), Government servants who retired before 2.9.08 with qualifying service of 33 years will continue to be proportionate to the full pension based on their actual qualifying service.

As per the said clarification OM dated 12.05.09, the basis for taking this decision is the Government took a policy decision to implement the the provision for full pension after 20 years of service with effect from 2.9.08.

It was also clarified by the Government that in light of various decisions of Apex Court allowing the employer to fix a cut-off date for introducing any new pension/retirement scheme, the decision of Government is in accordance with the law and there is no violation of Article 14 of the Constitution.

Subject: Encashment of earned leave along with Leave Travel Concession while in service.

The undersinged is directed to refer to Rule 38-A of CCS (Leave Rules, 1972 regarding encashment of earned leave alongwith LTC while in service which says that Government servants are permitted to encash earned leave upto 10 days at the time of availing Leave Travel Concession subject to the condition that earned leave of at least an equivalent duration is also availed of by the Government servant simultaneously. This Department has been receiving a number of references from various faced by them as the facility of LTC is also admissible while availing Casual Leave.

2. The matter has been examined in this Department in consultation with the Ministry of Finance and it has now been decided to permit Government servants encashment of earned leave upto 10 days at the time of availing LTC without any linkage to the number of days and the nature of leave availed while proceeding on LTC.

3. These orders shall take effect from the date of issue.

4. Formal amendment to the provisions of CCS(Leave) Rules, 1972 are being issued separately.

UP govt to implement 6th Pay Commission report

LUCKNOW: Uttar Pradesh government on Saturday decided to revise the pay scale of staff of all state-owned enterprises and corporations and to provide other benfits as per the recommendations of the Sixth Pay Commission with effect from January 1, 2006.

The decision will benefit about 98,000 employees and officers of public sector enterprises and corporations except energy sector undertakings, a government spokesman said here.

It will entail an additional burden of Rs 305 crore annually which will be borne by the enterprises and corporations.

However, the benefits of revised pay scale and other benefits will be subject to the economic capability of corporations and certain conditions, he said.

"No government assistance will be provided," the spokesman said.

The government also decided to relax rules regarding payment of dearness allowance to the staff of enterprises and corporations and merge 50% of the DA with the salary.

As per the decision, DA could be paid after assessiong the financial condition on the basis of audited balance sheet.

To simplify the process, it has been decided to set up an empowered committee at the level of public enterprises department, the official spoeksman said.

LUDHIANA: Irked over the policies of the railway authorities and the alleged injustice being meted out to them, members of the All-India Loco Running Staff Association sat on a 24-hour hunger strike here on Thursday.

The members protested against the fixation of grade pay of assistant train drivers in the 6th Pay Commission. They also demanded that in order to save money, the authorities were not recruiting new drivers in the railway department, due to which existing drivers had to work for more than 14 hours. The members said such things were a threat to the safety of commuters because it was the responsibility of drivers to provide safe journey to commuters. "If drivers get fatigued out due to extra working hours, it would definitely affect their health and the safety of people," they added.

"There is need of 100 loco pilots at the city loco shed to move trains so authorities need to increase the number of drivers as well as fix the working hours up to 8 hours,' the members said.

Meanwhile, the members also demanded that the authorities need to review their decisions because they had fixed the basic grade pay of assistant drivers on the basis of class IV employees, but assistant drivers were more qualified than class IV staff.

"The authorities should fix Rs 2,800 but they are only getting Rs 1,900. The authorities are also not giving justified travelling allowance to drivers," they rued. Talking to the TOI, Paramjeet Singh divisional secretary All India Loco Running Staff Association said, "Drivers and assistant drivers went for a hunger strike. Those on duty have also lent support to the cause." He demanded that the authorities should consider their demands and for that they are ready to conduct a meeting to find a possible solution to their demands. Singh said they would also stage a dharna in front of the Parliament on November 24 if the authorities don't address their problems.

Retired Central govt employees not getting revised pension

ALLAHABAD: Resentment is prevailing among the retired railway employees as they are not getting the revised pension as per the recommendations of
Sixth Pay Commission, asserted SK Singh, president of United Forum of Pensioners Association while addressing a meeting on Saturday.

He also said that retired employees of many Central government departments are not getting the revised pension due to the callous attitude of the authorities concerned.

He said that though the retired employees have been given the revised pension payment order (PPO) but the pensions have not been revised. The railway authorities have given assurance that all the works relating to the revision of pension would be completed by August but two months have passed and nothing has been done in this regard.

Another leader of the association Mobin Khan said that some of the retired employees have fixed the date of the marriage of their daughters, hoping that revised pension would come in handy. The retired employees have been forced to grapple with financial problems.

RBS Yadav, joint secretary of BSNL retired employees association asserted that resentment is brewing among the BSNL employees as they have not been paid industrial dearness allowance (IDA). Jordan H, district secretary of of the organisation said that the demand for merger of 50 per cent dearness allowance with the basic salary has not been implemented for the persons retired between October 2000 to December 2006.

KC Gupta, general secretary of United Forum of Pensioners Association said that the retired employees are united to fight for their problems. He informed that Pensioners Day would be observed on December 17 and urged the members to participate in the programme.
